These Terms and Conditions explain how the Perks Pass works, what you can expect from us and our Partners, and the limits of our responsibility. By purchasing or using a Perks Pass you accept these Terms and Conditions and our Privacy Policy.

If you do not agree, please do not purchase or use the Pass.

Definitions

  • Perks Pass means the one-off discount and deal pass sold by Local Adventures.
  • Partner means a participating business offering a discount, deal or benefit to valid Pass holders.
  • Pass holder means the individual who purchases the Perks Pass and is the primary user.
  • Additional users means the other people (up to three) who receive the benefit of the Perks Pass when present with the Pass holder.
  • We, us and our means Local Adventures.
  • You means the Pass holder.

What the Perks Pass is

The Perks Pass is a one-off purchase. It is not a subscription and does not renew.

The Pass is delivered as a digital wallet pass after you select your start date at checkout.

The Pass becomes active on your nominated start date and remains valid for the advertised validity period.

Who the Pass covers

  • The Pass covers the main Pass holder plus up to three additional users.
  • The main Pass holder cannot be changed after purchase.
  • Additional users can be changed at any time without advising us.
  • Only the main Pass holder receives and stores the digital wallet pass.

Using the Pass with Partners

  • Partners provide the deals, discounts and benefits listed on our website and displayed within the Pass.
  • Each Partner sets their own conditions for redemption, such as minimum spend, blackout dates or booking requirements.
  • Partner offers may change at any time.
  • You are responsible for checking current offer details before using the Pass.
  • Partners are responsible for their own service, staff, operations and safety.

Our responsibility for Partners

We provide the Perks Pass. We do not provide the goods or services delivered by Partners.

We are not liable for any Partner actions, behaviour, quality issues, cancellations, changes, safety concerns or service failures.

Any issues with goods or services received through a Partner must be taken up with the Partner directly.

You agree not to hold us responsible for any loss or damage arising from interactions with Partners.

Refunds and cancellations

  • Unused and non-activated Passes may be refunded within 5 days of purchase. Payment processor fees will be deducted.
  • A Pass is considered activated once it has been installed in a digital wallet or the start date has arrived.
  • Activated Passes are not refundable under any circumstance.
  • No refunds apply due to changes in Partner offers or personal circumstances.

Your responsibilities

  • You agree to use the Pass fairly and honestly.
  • You must not attempt to misuse, copy or alter the digital Pass.
  • We may revoke a Pass without refund if fraud or misuse is detected.

Communications and marketing

By purchasing a Perks Pass, you agree that we may contact you with information about your Pass, updated Partner deals and occasional marketing messages related to the Pass.

You may opt out of marketing messages at any time, but essential service communications will still be sent.

Limitation of liability

Your use of the Pass is at your own risk.

To the full extent allowed under Australian law, we are not liable for any loss, damage, cost, injury or claim arising from:

  • your use or misuse of the Pass
  • changes made by Partners
  • Partner service quality or operations
  • interruptions or errors on our website
  • situations beyond our control

Where liability cannot be excluded under Australian Consumer Law, it is limited to the minimum amount required by law.

Insurance

We hold appropriate public liability insurance for our own operations.

This insurance does not cover activities or services provided by Partners.

Updates to these terms

We may update these Terms and Conditions at any time.

The most recent version will always be available on our website.

Your continued use of the Pass means you accept the updated Terms.

Partner and reseller arrangements

We may allow third parties to resell the Perks Pass.

Resellers and Partners cannot alter these Terms and Conditions.

Governing law

These Terms and Conditions are governed by the laws of Queensland, Australia.

Any disputes must be handled through the courts of Queensland.

Purchasing Online

 

1. Minimum Age

  • You must be 18 or older to purchase. Minors may only purchase with a parent or guardian’s consent.

2. Product Descriptions

  • We strive for accuracy but do not guarantee all product descriptions are error-free.

3. Payment

  • All orders must be prepaid in AUD.
  • Credit card details are not stored on our servers.

4. Pricing and Taxes

  • Prices include GST unless otherwise stated.

5. Cancellation and Refund Policy

  • All non-activated tours and Perks PASSES are eligible for a refund within 5 days from your purchase date. Stripe fees will be taken from the refund amount. Non-activated means that you must not have logged into the Loquiz app and/or activated the Perks PASS.

6. Security

  • We use SSL encryption to protect your data. However, we are not liable for unauthorised access beyond our control.

Partner terms and conditions

These Partner Terms and Conditions apply to any business participating in the Perks Pass program offered by Local Adventures. By joining as a Partner, you agree to the obligations and expectations below.

Definitions

  • Partner means the business participating in the Perks Pass program.
  • Offer means the discount, deal or benefit the Partner provides to Perks Pass holders.
  • Pass holder means the individual who holds a valid Perks Pass.
  • Program means the Perks Pass partner network operated by Local Adventures.
  • We, us and our means Local Adventures.
  • You means the Partner.

Participation in the program

  • Participation is voluntary and can be withdrawn at any time by either party.
  • Your business details and current Offers will be displayed on the Local Adventures website and may appear in promotional material.
  • You agree to keep your Offer accurate and up to date. If your Offer changes, you must notify us immediately.

Your obligations as a Partner

  • honour the current Offer exactly as advertised
  • provide clear and fair redemption conditions
  • ensure your staff understand how to verify and process a Perks Pass
  • provide safe, lawful and high-quality products and services
  • hold all required licences, permits and insurances

You may update or withdraw your Offer at any time. Updates will generally take effect within 48 hours.

Partner responsibility for service delivery

You are solely responsible for the goods and services you provide to Pass holders.

Local Adventures does not guarantee or control Partner service quality, safety, pricing, staff behaviour or availability.

Any complaints or claims relating to your service must be handled directly by your business.

Verification of a Perks Pass

A valid Perks Pass will always display:

  • the Pass holder’s name
  • the Pass ID
  • the Pass validity period

You agree to check the validity of the pass by sighting the pass or looking it up online.

A Pass covers the Pass holder plus up to three additional users.

Liability and indemnity

You agree that Local Adventures is not responsible for:

  • partner operations, accidents, injuries or service issues
  • pricing errors or offer misunderstandings
  • loss or damage suffered by Pass holders while engaging with your business

You indemnify Local Adventures against all claims, costs, losses and liabilities arising from your participation in the program, including those caused by your staff, services, premises or products.

Removal from the program

We may remove a Partner from the program without notice if:

  • offers are not honoured
  • misleading or unsafe conduct occurs
  • complaints indicate poor or unsafe service
  • the Partner breaches these Terms

Removal does not affect any other legal rights we may have.

Marketing and promotion

By participating in the program, you agree that we may feature your business in digital marketing, printed materials, social media, SMS notifications and deal alerts sent to Pass holders.

You may request removal from certain marketing uses, but we cannot guarantee immediate removal from materials already published.

These Partner Terms and Conditions are governed by the laws of Queensland, Australia.
